The terms, in plain English.
These terms apply when you work with John Kirker Inc. (“I” and “me” below; the work is always mine). A proposal or engagement letter for a larger engagement can add to these terms; where the two differ, the signed document wins.

What it is
A private 90-minute working session on one decision, by video or in person in Orange County by arrangement, followed by a written summary within three business days.
Fee
$1,500, charged two business days after the written summary is delivered. One decision per session; if a second one comes up, we book a second session.
Pay only if it was worth it
Your card will be charged two business days after the summary has been delivered. If you don't feel the session was worth it, tell me before and you won't pay a dime.
Delivered means sent
The summary counts as delivered when I email it to the address you gave when booking. The two business days are counted from that email, excluding weekends and US federal holidays.
A card holds your time
When we agree a time, you save a card through Stripe. Nothing is charged then. The card is used only for the session fee as described above, or for a no-show fee.
Rescheduling and no-shows
Reschedule any time up to 48 hours before we meet at no charge. If you miss the session, or cancel with less than 48 hours' notice, a $500 fee is charged to the card on file.
Credit toward engagements
The full session fee is credited against the diagnostic or any other engagement we start within twelve months of the session.
If I have to move it
If I cancel or can't make a session, there is no charge of any kind, and we find another time or part ways.
Confidentiality
Everything you share before, during and after our work is held in strict confidence. Nothing about your company appears anywhere, including on this site, without your written consent.
What it isn't
My work is business judgment. It is not legal, financial, accounting, tax or investment advice. Where a decision needs a lawyer, a CPA or another licensed professional, I'll say so.
Decisions stay yours
I give you my best judgment and the reasoning behind it. The decisions, and what follows from them, are yours. Past results described on this site don't promise future ones.
Limit of liability
To the extent the law allows, my total liability for any engagement is limited to the fees you paid for it, and neither of us is liable for indirect or consequential losses.
Disputes
If something goes wrong, tell me first and we'll try to sort it out directly. These terms are governed by California law, and any dispute is heard in Orange County, California.
